1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and BTW Media Corp. ("we," "us," or "our") and govern your access to and use of https://www.hairtransplant.vn and any related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service Is — and What It Is Not
HairTransplant.vn is an information and referral platform. We publish information about hair transplant procedures and connect users with independent third-party clinics ("Clinics"). We do not own, operate, manage, control, or supervise any Clinic.
We are not a medical provider. We do not employ physicians, surgeons, or other clinicians. Nothing on the Service constitutes medical advice, diagnosis, or treatment, and no doctor-patient relationship is created with us. Always consult a qualified healthcare professional before making medical decisions.
Any contract for medical services is exclusively between you and the Clinic you choose. We are not a party to that contract.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.
4. How the Service Works
- You browse information and Clinic listings on the Site.
- You may submit a consultation request or contact form. The information you submit is forwarded to the Clinic or Clinics you select or that match your stated criteria.
- The Clinic will contact you directly. Pricing, availability, treatment plans, scheduling, payment, and any contract for services are arranged exclusively between you and the Clinic.
5. No Endorsement; No Guarantees
Information and Clinic listings are provided for general informational purposes and are believed to be accurate when published, but we make no warranty of accuracy, completeness, currency, or fitness for any particular purpose. Pricing displayed on the Site is indicative; final pricing is set by the Clinic. We do not endorse, recommend, or guarantee any Clinic, surgeon, procedure, outcome, licensing status, qualification, or insurance coverage. You are solely responsible for evaluating any Clinic before engaging it.
6. Your Responsibilities
- Provide accurate, current, and complete information when using the Service.
- Use the Service only for lawful purposes and in accordance with these Terms.
- Do not misuse the Service, including by attempting to interfere with security, scrape content at scale, reverse engineer, or use automated means to access the Service except as expressly permitted.
- Do not submit content that is unlawful, infringing, defamatory, or that you do not have the right to share.
7. Intellectual Property
The Service and all content we provide, including text, graphics, logos, images, and software, are owned by BTW Media Corp. or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use. All other rights are reserved.
8. User-Submitted Content
If you submit information, photographs, reviews, or other content through the Service, you grant BTW Media Corp. a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content for the purpose of operating, providing, and improving the Service and forwarding inquiries to Clinics. You represent that you have the rights necessary to grant this license.
9. Privacy
Our Privacy Policy describes how we collect, use, and share information. By using the Service you agree to that policy.
10. Third-Party Services and Links
The Service may include links to third-party websites and services, including Clinic websites. We are not responsible for those third parties or their content, products, services, or practices. Your dealings with any third party are solely between you and that party.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE MAKE NO WARRANTY REGARDING ANY CLINIC, SURGEON, PROCEDURE, OR OUTCOME, AND DISCLAIM ALL LIABILITY ARISING FROM ANY MEDICAL TREATMENT YOU OBTAIN FROM A CLINIC OR ANY OTHER THIRD PARTY.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BTW Media Corp. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to that extent.
13. Indemnification
You agree to indemnify, defend, and hold harmless BTW Media Corp. and its affiliates and personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, your violation of any law, or your dealings with any Clinic or other third party.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.
15. Dispute Resolution; Binding Arbitration; Class Waiver
Please read this section carefully. It affects your legal rights.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally within thirty (30) days of written notice will be finally resolved by binding arbitration administered by American Arbitration Association (AAA), seated in Delaware under its then-current commercial arbitration rules. The arbitration will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver: You and BTW Media Corp. agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator has no authority to consolidate claims or preside over any form of class or representative action.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.
16. Changes to the Service or Terms
We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
17. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, indemnities, and limitations of liability.
18. Miscellaneous
These Terms, together with the Privacy Policy and any other notices we publish, constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely.
